MICHIGAN HATE CRIMES BILL PACKAGE:

HB 4474: Amend the Michigan Penal Code in reference to Hate Crime Laws

Last Action: On Jun 21, 2023, bill “REFERRED TO COMMITTEE ON CIVIL RIGHTS, JUDICIARY, AND PUBLIC SAFETY.”

Summary: HB 4474 will amend 1931 PA 328, entitled “The Michigan penal code,” to specify that a person is “guilty of a hate crime” if that person commits any of the following acts due to the actual or perceived characteristics – such as race or color, religion, sex, sexual orientation, gender identity or expression, physical or mental disability, age, ethnicity, national origin, association or affiliation with an individual or group of individuals based on a characteristic described here – of another individual:

  1. Uses force or violence on another individual.
  2. Causes bodily injury to another individual.
  3. Intimidates another individual.
  4. Damages, destroys, or defaces any real, personal, digital, or online property of another individual without the consent of that individual.
  5. Threatens, by word or act, to do any of the actions above.

HB 4477: Amend the Michigan Code of Criminal Procedure to Include Institutional Desecration

Last Action: On Jun 21, 2023, bill “REFERRED TO COMMITTEE ON CIVIL RIGHTS, JUDICIARY, AND PUBLIC SAFETY.”

Summary: HB 4477  will amend 1927 PA 175, entitled “The code of criminal procedure,” to include the following as felonies:

  1. Institutional 10 desecration involving $20,000 or more or with prior convictions.
  2. Institutional desecration involving $1,000 to $20,000 or with prior convictions.

Summary: HB 4446 will designate Diwali, Deepavali, or the Festival of Lights as a holiday in Michigan. The new moon day on the eighth lunar month, according to the Indic pūrṇimānta lunisolar calendar, shall be known as “Diwali”, “Deepavali”, or the “Festival of Lights”, a holiday celebrated by Hindus, Jains, and Sikhs.
